Terms of Service
Last updated: 23 October 2026
These terms govern your use of Malpera (malpera.com), an AI-assisted builder for websites and web apps operated by Ferhat Çaldıra, Norway (“Malpera”, “we”, “us”). By creating an account or using the service you agree to these terms and to the Privacy Policy. If you do not agree, please do not use Malpera.
1. What Malpera does
You describe what you want in plain language; Malpera uses AI models to write the code and content of a website or web app, lets you change it by chat, by planning first or by clicking on the page, and can host and publish it at an address we provide or on your own domain. Depending on what you build, Malpera also runs supporting services for your project: a database and file storage, user accounts (including “Continue with Google”), server-side functions, scheduled jobs, e-mails, AI features and payments. The service is still evolving: features may be added, changed or removed, and access may at times be limited by invitation.
2. Your account
- You sign in with a Google account or with a one-time code sent to your e-mail. There is no Malpera password; keep your e-mail and Google account secure.
- You must be at least 16 years old, or the age of digital consent in your country if higher, and able to enter into a contract.
- Give us a real e-mail address that you control. One person or organisation per account; do not share sign-in access. To prevent abuse we limit how many new accounts can be created from the same connection or browser per day, we do not accept disposable e-mail addresses, and we may ask for a short automated check before creating an account. You may invite team members to a project, and you are responsible for what they do in it.
- You are responsible for everything done through your account. Tell us at once if you believe it has been misused.
3. Plans, credits and payment
- Credits. Building, editing, planning and asking questions use AI models. Each request uses credits according to its actual AI cost; a short edit uses few credits, a new app uses more. After each request you see the exact amount spent and your remaining balance. Automatic checks, tests and fixes that run as part of a request are included in its cost. Each request has an upper credit limit and you are never charged more than your remaining balance. If a request fails because of an error on our side or on the AI provider’s side, or produces no usable result (for example no change could be saved), you are not charged for it. If you stop a request before it finishes, the credits used up to that point are charged.
- Usage limits. To keep the service fair and to prevent abuse, each plan has a daily usage limit in credits and a limit on how many requests can run at the same time (see malpera.com/pricing). The daily limit applies to your monthly credits only: reaching it does not remove them, and you can continue the next day. Extra credits you buy can be used at any time. If overall demand or cost is unusually high we may briefly pause new requests on the free plan.
- AI features inside your apps. If you add an AI feature to your app and do not enter your own AI key, use of that feature by your app’s users and visitors is also taken from your credits at its actual cost. A daily budget that you set per project applies (when it is used up the feature stops for that day), and you can switch it off at any time by setting the budget to 0. If you enter your own AI key, that provider bills you directly and no Malpera credits are used.
- Plans. The free plan includes a one-time allowance of welcome credits when you create your account; it does not renew. Paid plans (currently Starter and Pro, see malpera.com/pricing) include a larger monthly allowance and your own domain, and can be paid monthly or, where offered, yearly. Monthly credits renew on your billing date; on a yearly plan they renew every month from your billing date. Unused monthly credits do not carry over. If you cancel a yearly plan, it stays active until the end of the year you paid for. There is no limit on the number of projects. Sites published on the free plan show a small “Made with Malpera” badge; you may not hide or remove it while the site is on the free plan. Paid plans remove it automatically.
- Extra credit packs are one-time purchases. Extra credits do not expire while your account is open and are used after your monthly credits.
- Prices and taxes. Prices are shown in euros and exclude VAT or sales tax, which is calculated at checkout based on your location and added to the price. We may change prices and what a plan includes; changes to a running subscription take effect from the next billing period, after notice.
- Who you pay. Payments are processed by Stripe. For purchases made through Stripe Managed Payments, Stripe (or its affiliate) acts as the reseller and merchant of record: it sells you the plan or credit pack, collects and remits the applicable taxes, issues your receipt and handles payment questions and disputes. Stripe’s terms for buyers apply to the payment itself; these terms apply to your use of Malpera. We never see or store your full card details.
- Renewal and cancellation. Subscriptions renew automatically every month until you cancel. You can cancel at any time under “Manage subscription”; the plan stays active until the end of the period you have paid for and then moves to the free plan. Upgrades take effect immediately and the price difference for the rest of the period is charged at once; downgrades take effect at the end of the current period.
- Refunds. Because credits give immediate access to digital services, payments are generally non-refundable once the plan or credits have been made available, except where the law requires otherwise. If you are a consumer in the EU/EEA or the UK, you agree that the service starts immediately after purchase and you acknowledge that you lose your right of withdrawal once you begin to use it; if you have not used any of the purchased credits, you may ask for a refund within 14 days. Stripe may also issue refunds under its own policies. If a payment is refunded or reversed through a chargeback, the credits it added are removed from your account; if it was a plan payment (monthly or yearly) and it is refunded in full, the subscription ends immediately and your account returns to the free plan.
- Credits have no cash value, cannot be transferred or exchanged for money, and lapse if your account is closed.
4. Your content and what you build
- You own the text, images and other material you provide, and the websites and apps generated for you, to the extent permitted by law. You may download the source code and host it anywhere.
- You grant us a licence to store, process, display and transmit your content only as needed to run the service (for example, to build, preview, back up and publish your project, and to send your requests and images to the AI providers described in the Privacy Policy).
- You confirm that you have the right to use everything you upload or ask Malpera to include (texts, images, logos, names, data).
- You are responsible for what you publish and for complying with the laws that apply to you (consumer, privacy, e-commerce, advertising, accessibility and others).
5. AI-generated code and content
Everything Malpera builds is produced by AI models. The output can be inaccurate, incomplete, insecure or unsuitable for your purpose, and similar output may be generated for other users. Malpera runs automatic checks, but they cannot find every mistake. Review and test everything before you publish or rely on it, especially facts, prices, legal statements, contact details and anything involving money or personal data. When the AI invents placeholder details for your business, it lists them for you to check; correcting them is your job. Stock photos are selected automatically from third-party libraries under their own licences; replace any that do not fit. AI-generated material may not be protected by copyright in every country.
6. Apps that have their own users
- You are responsible for your users. When your app collects personal data (accounts, forms, bookings, orders, files), you are the controller of that data and Malpera processes it for you as described in the Privacy Policy. You must tell your users what you collect and why, have a lawful reason for it, answer their requests and publish your own privacy notice and terms where the law requires them.
- Database and storage. By default your app’s data is stored in a database that Malpera manages and shares between apps, with each app’s data separated by access rules. Fair-use limits apply (requests, storage, run time); we may slow down or pause an app that overloads the shared infrastructure, and we will tell you. You may instead connect your own Supabase account; then Supabase’s terms, limits and prices apply to that account.
- Security check. Before an app can be published, Malpera automatically tests its access rules and blocks publishing if it finds a problem. This reduces risk but does not guarantee that an app is free of every vulnerability.
- Sign-in with Google in your app. Malpera operates this sign-in for your app with its own Google registration, so Google’s screen shows the name Malpera. You may use the e-mail address and name you receive only to run your app for that user.
- E-mails. Your app may send account e-mails and notifications related to something the recipient did or asked for. You may not use it for marketing lists, bulk mailings or messages to people who have no relationship with your app. Sending limits apply.
- Server functions, scheduled jobs and outside services. Code that runs for your app may contact only the outside services it declares, within time and usage limits. If you add keys for outside services, you are responsible for those accounts and their costs.
- Payments in your app. If you turn on payments, Stripe opens an account for you and your customers pay you directly through Stripe. You are the seller: you are responsible for your products, prices, taxes, delivery, refunds and disputes, and Stripe’s terms and fees apply to your account. Malpera is not a party to the sale, never holds the money and currently takes no fee on sales. Payments start in test mode, in which no real money moves. We are opening real payments step by step; until they are available for your app, it runs in test mode only. Once they are available, you switch to real payments yourself after Stripe has verified your account; an unverified account cannot take payments. We may pause real payments for all apps if a security or payment problem requires it.
7. Acceptable use
You may not use Malpera, or anything you build with it, to:
- break the law or infringe anyone’s rights (copyright, trademarks, privacy, publicity);
- deceive people — phishing, fake shops, impersonating a person or organisation, collecting passwords or payment details under false pretences;
- distribute malware, send spam or unsolicited bulk messages, or scrape or overload other services;
- harass, threaten or exploit anyone, publish sexual content involving minors, or promote violence or hatred;
- collect sensitive personal data (health, finances, children’s data and similar) without the legal basis and safeguards the law requires;
- run anything where a failure could cause death, injury or serious damage;
- abuse the service: automated bulk generation, circumventing credits, budgets or limits, probing or attacking our systems or other users’ apps, mining cryptocurrency, or reselling access to Malpera.
We may remove content, unpublish apps, limit features or close accounts that break these rules, and we may report unlawful content to the authorities.
8. Publishing, availability and changes to the service
Published sites and apps are served from our infrastructure. We aim for high availability but do not guarantee uninterrupted or error-free service: maintenance, provider outages or capacity limits may delay requests (you may be placed in a queue) or temporarily affect published apps. We keep backups for our own recovery purposes, but you should download a copy of anything important. We may add, change or remove features, limits and the free publishing address; where a change materially reduces what you already paid for, we will give reasonable notice. Published sites and apps include a small cookie-free visit counter so you can see your visit statistics in Malpera (described in the Privacy Policy); if you publish a privacy notice for your visitors, mention it there.
9. Intellectual property
Malpera’s software, design, name and logo belong to us and are not transferred to you; you receive a personal, non-exclusive right to use the service under these terms. The projects you build are yours (section 4). They include open-source components that remain under their own licences. If you send us feedback or ideas, we may use them without owing you anything.
10. Third-party services
Malpera relies on other companies (for example AI providers, Stripe, Supabase, Google and e-mail delivery). Where you use them through Malpera or connect your own account with them, their terms also apply, and we are not responsible for their services.
11. Suspension and closing your account
You can stop using Malpera and delete your projects at any time; write to us to delete your account. We may suspend or close accounts that break these terms, create risk for others or for the service, remain unpaid, or have been inactive for a long time, with notice where reasonable. When an account is closed, its published sites and apps go offline, unused credits lapse and we delete your data as described in the Privacy Policy, except where we must keep it by law. Download what you want to keep before closing.
12. No warranty
Malpera, and everything built with it, is provided “as is” and “as available”, without warranties of any kind, express or implied — including that the service or its output will be uninterrupted, error-free, secure, accurate, lawful in your country or fit for a particular purpose. You use the service and its output at your own risk.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential damages, lost profits, revenue, customers or data, or for the content and operation of the sites and apps you create. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or NOK 500 if you paid nothing). If someone brings a claim against us because of your content, your app or your breach of these terms, you will cover our reasonable costs, to the extent the law allows. Nothing in these terms limits liability that cannot be limited under applicable law, including consumer rights in your country.
14. Changes to these terms
We may update these terms as the service evolves. Material changes will be announced in the app or by e-mail at least 14 days before they take effect. Continued use after that date means you accept the new terms.
15. Governing law
These terms are governed by the laws of Norway. Disputes are subject to the courts of Norway, without prejudice to mandatory consumer protection in your country of residence.
